NOTICE AND CONSENT FOR PROCESSING PERSONAL DATA

 

ATRIUM PROPERTY SERVICES DOO BEOGRAD (NOVI BEOGRAD), from Belgrade, Bulevar Mihajla Pupina 165G, reg.no.: 20073373, TIN: 104013279, represented by legal representative director Roman Klott (hereinafter referred to as: the Company) processes certain personal data in the capacity of data manager as a part of the performance of its registered activity.

 

To this end we provide you the following notice regarding processing of your personal data (hereinafter referred to as: Data), all in accordance with Article 15 of Law on Personal Data Protection ("Official Gazette of the RS", No. 87/2018 - hereinafter referred to as "the Law"):

 

1. Data that shall be processed

 

Within performance of its registered business activity, the Company shall collect and process from you the following personal data:

 

• title, first name and last name, address of domicile/residence, personal number, gender;

• e-mail address;

• mobile phone/phone number;

• citizenship;

• country of residence, and

• preferred language (Serbian and/or English);

• members of the household (first name and last name);

• data on lessees or other users (first name, last name, mobile phone, email).

 

2. The purpose of collecting and further processing

 

The Company, in accordance with the decision on the entrustment of facility maintenance in accordance with article 42 paragraph 1 item 7 of the Law on Housing and Maintenance of Buildings ("Official Gazette of RS", No. 104/2016) („the Decision“) i.e. in accordance with the agreement on the entrustment of facility management and maintenance concluded in accordance with article 60 paragraph 3 of the  Law on Housing and Maintenance of Buildings ("Official Gazette of RS", No. 104/2016) („the Agreement“), performs facility management of the building, cleaning and maintenance of common parts of the building and land for regular use of the building, security services, gardening and snow removal, pest control services, as well as all other services that in the aforementioned capacity will provide in its professional activity and to offer service users, including additional services.

 

Your personal data defined under item 1. of this notice shall be collected if you are the owner or lessee of a separate part of residential – business building, and in that sense, the User of the services provided by the Company. The purpose of collecting personal data is to enable the payment of the Company’s services through the Internet portals, as well as to reach you in connection with your interest and understanding of your needs and habits, in order to provide better service by the Company. Also, we collect and keep data on your purchases and purchase habits, in order to, through analysis of that data, upgrade and personalize our services. The e-mail address and mobile phone/phone number shall also be used to inform the Service User of the services provided by the Company, for promotional purposes. Citizenship and Gender data is collected for the purpose of market research and offer enhancement. Data about preferred language of communication is collected to define the language of communication as well as to provide information on your current debt per housing unit at all times.

 

Processing of personal data – first and last name, personal number and address of domicile/residence is necessary for performance of the Decision and the Agreement, where you are the User of the services we provide, as subject on which data are referring to and/or for performing actions, at your request, as respective subjects on which data are referring to. The provision of this personal data is necessary condition for the performance of the Decision, Agreement, and respectively, the provision of services.

 

Your personal data shall only be used for the aforementioned purposes, unless otherwise required by law.

 

The Company shall perform the collection, recording, copying, searching, sorting, storage, separation, modification, usage, disclosure, organization, and customization of the collected data.

 

3. The manner of data usage

 

The data processing shall be automatic, semi-automatic and/or manual.

 

4. Information about data users

 

The Company shall not release your personal data from item 1 for use by other persons except in the case of a legal obligation, respectively, in the case of processing by other persons, necessary for the preparation of documents/invoices in order to fulfill the purpose of collecting data.

 

The Company does not intend to release personal data to another country or international organization.

 

The Company does not perform automated decision-making or profiling on the basis of the personal data provided.

5. Obligation and legal basis for data processing

 

Legal basis for data processing – first name and last name, personal number and address of domicile/residence are Article 42 and 60 of the Law on Housing and Maintenance of Buildings ("Official Gazette of RS", No. 104/2016), Article 8 of the Law on Accounting ("Official Gazette of RS", No. 62/2013 and 30/2018), as well as your consent.

 

Consent to the collection and processing of other mentioned data is voluntary.

 

You may revoke your data processing consent at any time, provided that the Company may continue to process your data to the extent necessary to comply with the above legal obligations.

 

6. Your rights

 

You have the following rights in relation to the processing of personal data by the Company:

 

1. The right to require the Company to access, correct or delete personal data,

2. The right to require the Company to limit the processing,

3. The right to object,

4. The right to data portability,

5. The right to revoke consent at any time, provided that revocation of consent does not affect the admissibility of processing on the basis of consent prior to revocation,

6. Right to submit a complaint to the Commissioner,

7. The right to know whether the Company processes your personal data,

8. Access to your personal data, information about the purpose of the processing, the types of data being processed, the recipient or types of recipients to whom the personal data have been disclosed or will be disclosed, and in particular to recipients in other countries or international organizations, on the due date keeping personal data, or, if this is not possible, the criteria for determining that deadline.

 

At your request, the Company shall provide you with a copy of the data it processes that relate to you. The Company may require reimbursement of necessary expenses for the drafting of additional copies required by the data subject. If the request for a copy is submitted electronically, the information shall be provided in the commonly used electronic format.

 

You can realize the abovementioned rights by contacting the Company as follows.

 

The abovementioned rights may be restricted in order to comply with the legal obligation of the Company which requires the processing or execution of business activity, or the purpose in filing, realization or defending a legal claim.

 

7. Other information relevant to the processing of your data

 

The Company storages your data for a period not longer than is necessary for compliance with legal obligations in accordance with Article 24 of the Law on Accounting ("Official Gazette of RS", No. 62/2013 and 30/2018), in administrative, legal or security purposes, respectively, for the duration of the Decision and Agreement. The processing of data based on your consent will be performed until the consent is revoked.

 

8. Protection measures

 

The Company shall take appropriate organizational, technical and personnel measures to protect your personal data in accordance with applicable laws regarding the protection of personal data as well as the standards applicable in the field of physical and electronic data security.

 

Your personal data shall be treated as confidential information. Only persons who will have access to them, given their job description in the Company, should have access to them, and that only to the extent necessary for the performance of their jobs.
